Internal Ius ad bellum in destabilized situations: the case of the Republic of Ecuador

Abstract
Introduction: this paper addresses the right to defense in public international law and its implications in gray areas of normative application, as occurs in Ecuador, a country where the government has declared an “internal armed conflict” due to episodes of violence related to the activities of organized crime. Aim: with this background, the aim of this article is a) stablish a general situation regarding the events that occurred in Ecuador b) examine the concept of ius ad bellum in the context of new threats and c) describe the relevance of its use in internal security. Methodology: therefore, in the context of the current violence in Ecuador, this research explores the implications of the doctrine of ius ad bellum and the right to legitimate defense through the interpretation of legal doctrine and the classic security/defense dichotomy. Conclusions: since 2022, the country has experienced a situation that could be characterized as an “internal ius ad bellum”. Finally, to improve the management and normative understanding of the issue, this study offers elements of reflection around the Ecuadorian conflict.
